Terms of Service – Online Learning Platform

1. Scope and Priority of Terms

These Terms of Service (“LMS Terms”) govern your access to and use of the online learning platform located at courses.surefirecpr.com (the “LMS”), including all digital course content, materials, videos, assessments, and online services provided exclusively through the LMS.

IMPORTANT: If you participate in any in-person training, hybrid training, skills verification session, hands-on activity, or use of any physical CPR training equipment provided by SureFire CPR, LLC, then the Training Terms, Assumption of Risk & Liability Waiver located at https://surefirecpr.com/terms-and-conditions/ shall govern and control to the fullest extent permitted by law and shall take priority over these LMS Terms in the event of any conflict.

2. Acceptance of Terms

By accessing or using the LMS, creating an account, enrolling in a course, or purchasing online training, you acknowledge that you have read, understood, and agree to be bound by these LMS Terms.

If you do not agree to these LMS Terms, you may not access or use the LMS.

3. Eligibility

You represent that you are at least the age of majority in your jurisdiction or have the consent of a parent or legal guardian. You agree to provide accurate and complete information when creating an account.

4. LMS Access and Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You may not:

  • Share your login credentials
  • Allow unauthorized access to your account
  • Circumvent course completion requirements or assessments

SureFire CPR reserves the right to suspend or terminate accounts that violate these LMS Terms.

5. Course Content and Intellectual Property

All LMS content, including videos, text, graphics, assessments, and instructional materials, is owned by or licensed to SureFire CPR and is protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use LMS content solely for your personal educational use.

You may not:

  • Copy, reproduce, distribute, or resell LMS content
  • Record or share course materials
  • Use LMS content for commercial purposes without written permission

6. Course Completion and Certification

Completion of online coursework through the LMS does not, by itself, guarantee certification. Certification requirements may include additional steps such as skills verification or assessments governed by separate Training Terms.

SureFire CPR makes no guarantee that completion of LMS coursework alone satisfies employer, licensing, or regulatory requirements.

7. Payments and Refunds

Payments for LMS courses are processed through authorized payment providers. All pricing, refund eligibility, and rescheduling policies are governed by the policies disclosed at the time of purchase.

SureFire CPR reserves the right to modify pricing or course availability at any time.

8. Accuracy of Information

LMS content is provided for educational purposes only. While SureFire CPR makes reasonable efforts to ensure accuracy, we do not guarantee that course content is error-free, complete, or current.

You agree that reliance on LMS content is at your own risk.

9. No Medical or Legal Advice

LMS content is educational only and does not constitute medical, legal, or professional advice. SureFire CPR does not provide medical diagnosis or treatment through the LMS.

10. Limitation of Liability – Online Learning Only

To the fullest extent permitted by law, your use of the LMS and digital course content is at your sole risk. SureFire CPR, LLC and its owners, officers, employees, instructors, contractors, affiliates, licensors, and service providers shall not be liable for any damages arising from your access to or use of the LMS or online course content.

For any physical training, hybrid training, skills verification, or equipment use, all assumptions of risk, liability waivers, and dispute resolution provisions are governed exclusively by the Training Terms, Assumption of Risk & Liability Waiver located at https://surefirecpr.com/terms-and-conditions/ .

11. Arbitration and Dispute Resolution

Any dispute arising out of or relating to your use of the LMS or online course content shall be resolved in accordance with the arbitration and dispute resolution provisions set forth in the Training Terms, Assumption of Risk & Liability Waiver, which are incorporated by reference.

12. Termination

SureFire CPR may suspend or terminate your access to the LMS at any time for violation of these LMS Terms or misuse of the platform.

Termination does not relieve you of obligations incurred prior to termination.

13. Privacy

Use and collection of personal information through the LMS are governed by our Privacy Policy located at https://surefirecpr.com/privacy-policy/ .

14. Governing Law

These LMS Terms shall be governed by and construed in accordance with California law, to the extent not preempted by applicable federal law. For disputes involving physical or hybrid training activities, the governing law provisions in the Training Terms shall apply.

15. Severability

If any provision of these LMS Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. Changes to LMS Terms

SureFire CPR reserves the right to update or modify these LMS Terms at any time. Continued use of the LMS after changes are posted constitutes acceptance of the revised terms.
